Partner Marcella Auerbach has served twenty-five years as a federal prosecutor. She has prosecuted corporations in a wide variety of circumstances, including matters involving FDA violations, healthcare fraud, anti-kickback and Stark law violations as well as Medicare fraud. She has taught at numerous panel discussions and training conferences for attorneys, federal and state prosecutors and agents on topics such as health care fraud, investigative techniques and federal court/trial advocacy. Medicare qui tam cases that she worked on while a federal prosecutor include a multi-million dollar recovery against a hospital chain for allegations of Medicare fraud brought by a whistleblower. The allegations were that the hospital failed to comply with Medicare coverage requirements regarding beneficiaries that had been placed in "observation status" in order to receive treatment or be monitored before making a decision concerning their next placement (i.e. being admitted to the hospital or discharged to home). Ms. Auerbach also has represented employees in whistleblower protection and other whistleblower-related actions against their employers.

A skilled and aggressive trial lawyer, partner Matthew Pavone is a former federal prosecutor who served for over ten years in the US Attorneys Office for the Southern as well as Northern District of California. A Phi Beta Kappa member, Mr. Pavone upon graduation from law school served as a law clerk to the Honorable W.T. Swigert, U.S. District Judge, and Northern District of California. He maintains an active individual practice in California.
