Kentucky Qui Tam Whistleblower case examples.

Medical equipment supplier, American HomePatient Delaware, agreed to pay $7 million to settle a qui tam suit alleging that it submitted claims for payment based on inadequate supporting documentation or on illegal patient referrals.  Settled in July 2002, the case involved allegations that the company used falsified or otherwise inadequate documents to support claims of medical necessity to overcharge Medicare, Medicaid and TRICARE during a four-year period from 1995-1998.

In September 2005, government contractor AdminaStar Federal agreed to pay $6 million to settle government allegations of Medicare fraud under the False Claims Act.  The Government alleged that AdminaStar tampered with Medicare files and claims information and hung up on customer service phone calls in an effort to improve scores on Medicare evaluations.

The purpose of the Qui tam provisions of the Federal False Claims Act is to encourage private individuals who are aware of fraud being perpetrated against the government to bring such information forward.
